Specification- In this that the said Tapeteto did join with and participate in the murders, robberies, and outrages committed by the Sioux Indian between the 18th day of August 1862 and the 28th day of September 1862 and particularly in the battles at the Fort, New Ulm, Birch Coolie, and Wood lake, and carried a flag at the last named battles which he offered to whoever would kill a white man.

I was at Birch Coolie, at Fort Ripley, and Wood Lake, in the battles. I fired twice at the Fort. After I fired these shots I ran to hunt for mules-got one but it got away. I fired one of the first shots at daybreak at Birch Coolie, in the direction of the white men’s wagons and tents, where the white men were talking. I fired four shots at the last battle at Wood Lake. I fired 8 shots in all. I fired my double barreled gun 4 times.
And thereupon the case being closed, the Commission proceeded with their finding and sentence.
The Military Commission find the prisoner, the said Tapeteto, a Sioux Indian, as follows-
Guilty of the charge
Guilty of the specification, and sentence him to be hanged by the neck until he is dead.

Specification- In this that the said Tapeteto did join with and participate in the murders, robberies, and outrages committed by the Sioux Indian between the 18th day of August 1862 and the 28th day of September 1862 and particularly in the battles at the Fort, New Ulm, Birch Coolie, and Wood lake, and carried a flag at the last named battles which he offered to whoever would kill a white man.

The Prisoner states-
I was at Birch Coolie, at Fort Ripley, and Wood Lake, in the battles. I fired twice at the Fort. After I fired these shots I ran to hunt for mules-got one but it got away. I fired one of the first shots at daybreak at Birch Coolie, in the direction of the white men’s wagons and tents, where the white men were talking. I fired four shots at the last battle at Wood Lake. I fired 8 shots in all. I fired my double barreled gun 4 times.
And thereupon the case being closed, the Commission proceeded with their finding and sentence.
The Military Commission find the prisoner, the said Tapeteto, a Sioux Indian, as follows-
Guilty of the charge
Guilty of the specification, and sentence him to be hanged by the neck until he is dead.

They told me they wanted to go there and burn houses and steal horses. He told me they had burned houses and stolen horses.

I heard prisoner had been out to the Big Woods. As last witness states from other witnesses.

I heard Indians say prisoner was out to the Big Woods.
Thomas Robertson sworn says-
I know the prisoner. He told me at Yellow Medicine he had been on a war party to the Big Woods. I heard the party had burnt houses at a village at the Big Woods.

I saw prisoner at the fight at the Fort. He was running up the hill with the other Indians with something in his hand- a gun or a war spear.
And thereupon found guilty and sentenced to hang.

I haven’t followed the prisoner any where’s but I have heard he was on war parties.

The prisoner was at the Fort and at New Ulm with the under Indians with a gun.
