NOTE:
Today is four weeks since Judge Lettow issued his latest OPINION & ORDER so I thought I would check the PACER system to see if anything has been filed since then. I would not have been surprised to find that the defendant United States filed an appeal in order to avoid the task presented them by the COFC. There wasn't one, but they still could within 60 days from the August 22, 2011 corrected judgment. That task assigned to them is the creation by August 5, 2012 of a list of legitimate beneficiaries who are entitled to the monetary judgment from this lawsuit.
Plaintiffs and Intervening Plaintiffs should not be standing idly by for a year because if the defendant USA is not pressured to get on with the task, they will do what they have been doing for nearly 10 years; do nothing at all until August 2012 and then file motion for a one year extension to complete the task.
What can we do? There is a way we can apply pressure. Tomorrow September 3rd, or by Sunday September 4th by latest, I will post on this website HOW it can be done and WHY it will work.
Later . . . .
