Judge Lettow DENIES Defendant Government's
Motion For Reconsideration
Today Judge Lettow DENIED defendant USA'S MOTION for Reconsideration.

NOTE: Edited: 10/26/2011. I expect to see a defendant motion for leave to file an appeal in a couple of days (or whenever the deadline would be). This has gotten so ridiculous that I would not be surprised to see a defendant motion that Judge Lettow recuse himself because he thinks too much like plaintiff's counsel.

COFC Order Filed Regarding Defendant USA's
Motion to Place Exhibit L Under Seal
Today Judge Lettow GRANTED defendant USA'S October 18, 2011 MOTION to place Exhibit L to Mr. Cermak's Memorandum, filed October 13, 2011, under seal.

NOTE: It was obvious this order would be granted. Redaction of the full birth date is required for any filed document available to the public.
So now we wait for an OPINION & ORDER regarding the pending delay motion (Document 1100) filed by defendant USA on 9/2/2011 requesting Judge Lettow reconsider his 8/5/2011 OPINION & ORDER. This could come as early as tomorrow 10/21/2011 and available for download the following day.
Following on the heals of that decision will no doubt be an appeal from the defendant USA to further delay the inevitable construction of an up-to-date Mdewakanton Roll.
